A U.S. federal judge has ordered the Trump administration to proceed with registration for the delayed Diversity Visa 2027 programme, commonly called the Green Card lottery. The development gives eligible prospective applicants renewed reason to prepare, although a court-directed opening deadline should not be confused with confirmation that applications are already being accepted.

For readers in India, the announcement also raises an important question: who can participate? The Diversity Visa programme has country-of-birth eligibility rules, and reopening registration does not remove those requirements.

What Has the Court Ordered?

According to Business Standard’s reporting, U.S. District Judge Jinsook Ohta issued the October 14 order in Red Eagle Law, L.C. v. Rubio. Following a court-approved extension, the State Department must announce the registration schedule by October 29, 2026, and open the entry window by November 1, 2026.

The Times of India reports that registration is to remain open for 30 days, with selected applicants to be notified by December 3. These are reported court-directed milestones. Applicants should check the State Department’s announcement for the operational dates, closing time and instructions before submitting an entry.

Why Was DV-2027 Registration Delayed?

In a notice dated November 5, 2025, the State Department said it was implementing changes to the Diversity Visa entry process. It stated that the registration opening date and the date for accessing selection results would be announced later.

The same notice retained October 1, 2026, to September 30, 2027, as the visa application period for people selected for DV-2027. This distinction matters: the programme year identifies the fiscal year for visa processing, rather than simply the year in which registration takes place.

Can Applicants Born in India Participate?

Applicants should not interpret the reopening as a general invitation for everyone in India to apply. India-born applicants are generally ineligible, as Business Standard notes in its coverage of the ruling.

Official DV-2026 instructions excluded natives of India and provided limited alternative country-of-chargeability rules. For example, qualifying applicants could sometimes use an eligible spouse’s country of birth. A separate exception could apply through a parent’s birthplace, subject to specific conditions concerning the parents’ birthplaces and residence when the applicant was born.

These are conditional rules, not automatic exemptions. Applicants must consult the DV-2027 instructions before relying on an exception. Indian citizenship, residence abroad or a foreign residence permit alone should not be treated as proof of eligibility.

What Other Qualifications Are Required?

Country eligibility is only one part of the assessment. The State Department requires the principal applicant to satisfy the programme’s education or qualifying work-experience requirement. Applicants generally need a high school education or its equivalent, or qualifying work experience under the applicable rules. Not every job satisfies the work-experience standard.

Selection also does not guarantee a visa or permanent residence. Selected applicants must still establish eligibility and complete the required immigration process.

What Should Prospective Applicants Do Now?

Start with the official State Department Diversity Visa page and follow its instructions for accessing the Electronic Diversity Visa website.

The State Department requires electronic entries during the specified registration period. It does not accept late or paper entries, and submitting more than one entry for the same person during a registration period results in disqualification. Keep these rules in mind when using assistance to prepare an application.

Before applying, verify your country eligibility, review the current photograph and family-information requirements, and check the announced dates carefully. Avoid relying solely on headlines or assuming that the court order guarantees an individual immigration outcome.

For Phoenix Business Advisory readers, the practical takeaway is to follow the official implementation announcement and assess personal eligibility before taking action.
